End User License Agreement
Last updated: October 27, 2026
This agreement is between you and Vincent Dottai, who runs Vincent Dottai Marketing JDG, Ostrzycka 1/3, 82, 04-035 Warszawa, Poland ("we", "us"). It covers the ViralSwap app for Mac, its updates, and the files that come with it or that it gets from us (together, "the app"). It's part of our Terms of Service, and words used there mean the same here. By installing or using the app, you accept this agreement.
1. Your license
While you have an active ViralSwap subscription, we give you a personal, non-exclusive, non-transferable license to:
- install the app on Macs that you own or control; and
- use it on one Mac at a time for each subscription (the Mac where the subscription is active), to make videos for yourself or, if you're a business, for your business and its clients.
If you're a business, your employees and contractors may use the app for you on that Mac. You're responsible for what they do with it.
2. What you may not do
Except where the law or an open-source license (section 5) allows it, you may not:
- copy the app, except to install it and to make backups;
- modify, translate, decompile, disassemble or reverse-engineer the app, or try to derive its source code;
- remove or get around its license checks, the one-Mac rule, the daily limit or other limits;
- extract, copy, publish or reuse the instructions, prompts and rules for the AI models that come with the app or that it gets from us, or use them outside the app;
- rent, lend, sell, sublicense or share the app, or let others use your copy, for example by giving your clients access to it; or
- use the app against the law or our Terms of Service.
Where the law gives you the right to observe and test how the app works, or to decompile parts of it to make it work with other software, this section doesn't take that right away.
3. License checks
The app checks your subscription with our server about every hour and when you start videos, and keeps working for up to 3 days without a connection. For this it sends our server your session token, an ID derived one-way from your Mac's hardware ID, your Mac's name, your Mac's date, and a random ID for each video you start. It never sends us your reels, videos, photos or characters. The Privacy Policy explains this in full.
4. Other companies' tools
- During setup, the app installs Claude Code with Anthropic's own installer and downloads speech and face models from Hugging Face. Claude Code isn't part of the app; Anthropic's terms apply to it.
- The app includes Higgsfield's command-line tool, which works with your Higgsfield account. Higgsfield's terms apply to what you do on Higgsfield.
5. Open-source software
The app contains open-source software, including FFmpeg and ffprobe (GNU LGPL 2.1 or later) with LAME (LGPL) and dav1d (BSD), Higgsfield's command-line tool (MIT), Python (Python Software Foundation License), OpenCV (Apache 2.0), and other components under their own licenses. The license texts come with the app, in ViralSwap.app/Contents/Resources/runtime/licenses. Those licenses govern those parts, and nothing in this agreement limits the rights they give you; for example, you may use, change and replace the LGPL programs as their license allows. On request we send you the source code of the LGPL parts, for at least three years after each release: write to support@viralswap.io.
6. Updates
We may release updates to fix problems, to keep the app secure and working with macOS and the other companies' services, and to add or change features (Terms, section 14). During your subscription we provide the updates the app needs to keep working as the Terms describe. Older versions may stop working with our server. If you're a consumer and don't install an update we told you about, we're not responsible for a problem that the update would have fixed.
7. Ownership
The app is licensed, not sold. We and our licensors keep all rights in it, including in the instructions, prompts and rules for the AI models, and in the ViralSwap name and logo. The videos you make aren't ours (Terms, section 13).
8. Your data on your Mac
The app keeps your data on your Mac, mainly in ~/Library/Application Support/ViralSwap. Keep backups of what matters to you. Deleting the app doesn't delete your data; the Privacy Policy explains how to remove it.
9. How long this license lasts
This license lasts while your subscription is active. It ends automatically when your subscription ends or when we end your subscription under the Terms. When it ends, the app locks and you must stop using it; you may delete it. Sections 2, 7 and 10 to 13 still apply after the license ends.
10. Warranty
If you're a consumer, you have the legal rights described in section 15 of the Terms if the app doesn't work as it should. If you're a business customer, the app is provided "as is" and, as far as the law allows, without any warranty that it is free of errors, suits a particular purpose or runs without interruption.
11. Liability
Our liability for the app is set out in section 16 of the Terms.
12. Export control and sanctions
You may not use, export or transfer the app in breach of export control or sanctions laws, including those of the EU, the UN, the UK and the US.
13. Law, courts and contact
Sections 20 (law and courts) and 22 (other terms) of the Terms apply to this agreement. Questions about it: support@viralswap.io.
